Terms of Service

By using shelfish ("App"), you agree to these Terms of Service ("Terms").

1. Acceptable Use

You agree NOT to:

• Spam or manipulate the leaderboard system
• Make excessive API requests or abuse cloud functions
• Use profanity, racial slurs, or inappropriate language in display names
• Attempt to hack, reverse engineer, or extract API keys
• Upload images showing criminal activity, nudity, sexual content, or violence
• Harass, abuse, or threaten other users
• Violate any applicable laws

2. Account & Content

• You are responsible for your account and all activity under it
• Display names must be appropriate and non-offensive
• While images are currently private, you agree that any images uploaded comply with these Terms
• If image sharing becomes available, all content restrictions apply to shared images
• We may remove inappropriate content or suspend accounts without notice

3. Subscription Terms

Scan Results:

• Scans use stochastic computer models and may produce incorrect or empty results
• All scan attempts count toward your monthly limit, including poor results
• For best results, take photos in well-lit areas with clearly readable book titles
• If experiencing excessive poor scan results, contact us for a potential refund of your last month's subscription

Subscription Management:

• Subscriptions automatically renew unless cancelled 24+ hours before renewal
• Manage subscriptions through your App Store account settings
• Billing occurs within 24 hours of renewal period
• Valid subscription required to access app features and data

Data Ownership & Access:

• shelfish retains ownership of all uploaded images and data
• Users cannot access app features without valid subscription
• Data preservation after subscription expiry is at our discretion for an unspecified time
• We attempt reasonable data preservation but make no guarantees beyond active subscription period

4. Age Restrictions & Content Warning

• This app is not suitable for users under 13 years old
• User discretion advised: display names, book images, and titles may contain content unsuitable for children
• Parents are responsible for monitoring their children's use

5. Intellectual Property

• You may not copy, reproduce, or extract app code or stylistic content without explicit permission from James Kelly
• All app content and design elements are protected by copyright
• Users retain rights to their personal book collection data subject to our data ownership terms

6. Privacy

• Your use of the App is governed by our Privacy Policy: https://shelfishapp.com/privacy-policy.html
• Collected data includes: email address, book metadata, uploaded images, and record timestamps
• We collect technical data to improve the service
• Users have rights to delete their data as outlined in the Privacy Policy

7. Service Availability

• The App is provided "as is" without warranties
• We may modify, suspend, or discontinue features at any time
• Cloud functions and API access may have usage limits
• No guarantee of data persistence beyond active subscription period

8. Limitation of Liability

• Your use of the App is at your sole risk
• We are not liable for damages arising from your use of the App
• Maximum liability is limited to $50

9. Termination

• Either party may terminate your access at any time
• Upon termination, your right to use the App ends immediately
• You must remove the App from your devices if you sell them

10. Changes

We may update these Terms at any time. Continued use constitutes acceptance of changes.

11. Governing Law

These Terms are governed by Oregon law. Disputes will be resolved in Oregon courts.
